The Equal Employment Opportunity Commission today issued final regulations implementing Title II (the employment provisions) of the Genetic Information Non-Discrimination Act of 2008 (GINA). As we told you in an earlier post, Title II took effect November 21, 2009, and proposed regulations were published last year, but the final regulations had been delayed.
According to the EEOC press release, the final regulations give examples of genetic tests; more fully explain GINA’s prohibition against requesting, requiring, or purchasing genetic information; provide model language employers can use when requesting medical information from employees to avoid acquiring genetic information; and describe how GINA applies to genetic information obtained via electronic media, including websites and social networking sites. Look for future posts after members of the Dickinson Employment and Labor Law Group have had time to review and analyze these new regulations.
